These Terms and Conditions ("Terms") form a legally binding agreement between you ("Customer," "you," or "your") and Atlas Hue ("Company," "we," "us," or "our"), an Ontario, Canada-based company, governing your use of our window tinting services (the "Services"), our website (http://www.atlashue.com), and any other related interactions.
By requesting a quote, scheduling an appointment, or engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you may not use our Services.
1. Definitions
Company/We/Us/Our: Refers to Atlas Hue.
Customer/You/Your: Refers to the individual, company, or entity receiving the Services.
Services: Encompasses all window tinting services provided by Atlas Hue, including but not limited to automotive tinting, residential tinting, commercial tinting, consultation, and related activities.
Vehicle/Property: Refers to the automobile, home, or commercial building on which the tinting services are to be performed.

2. Services Offered
We specialize in professional window tinting services. Details of the specific services, film types, and associated costs will be provided to you in a written quote or estimate prior to service commencement.
3. Quotes and Estimates
All quotes and estimates are based on the information provided by the Customer and a visual inspection of the Vehicle/Property.
Quotes are valid for 5 days from the date of issuance unless otherwise stated.
Any significant changes to the Vehicle/Property condition, desired tinting specifications, or unforeseen issues discovered during the service may result in adjustments to the quoted price. We will inform you of any such adjustments and seek your approval before proceeding.
4. Booking and Appointments
Appointments can be scheduled via [mention methods, e.g., phone, website, in-person].
A non-refundable deposit of 50% may be required to secure your appointment. This deposit will be applied towards the total cost of the Services.
We reserve the right to reschedule or cancel appointments due to unforeseen circumstances (e.g., staff illness, equipment malfunction, severe weather). We will endeavor to provide you with as much notice as possible in such cases.
5. Payment Terms
Full payment for the Services is due upon completion of the work and prior to the release of the Vehicle/Property, unless otherwise agreed upon in writing.
We accept payments via [list accepted payment methods, e.g., credit card, debit, e-transfer, cash].
A service charge of 10% per month (or the maximum allowed by law) may be applied to overdue accounts.
In the event of non-payment, the Customer agrees to be responsible for all collection fees, including but not limited to legal fees and court costs.
Any custom-ordered materials or film required for your project may require 100% payment upfront and are non-refundable once ordered.
6. Customer Responsibilities
Vehicle/Property Preparation: For automotive tinting, the Customer is responsible for removing all personal belongings and ensuring the vehicle's interior is reasonably clean prior to the appointment. For architectural tinting, the Customer is responsible for clearing the work area of any obstructions.
Accuracy of Information: You are responsible for providing accurate and complete information regarding your Vehicle/Property and desired Services.
Inspection upon Completion: You are responsible for inspecting the completed work upon release of the Vehicle/Property. Any concerns or discrepancies must be brought to our attention immediately at the time of pick-up/completion. Your acceptance of the Vehicle/Property upon completion signifies your satisfaction with the Services rendered.
Post-Installation Care: You agree to follow our recommended post-installation care instructions to ensure the longevity and proper curing of the window tint. We are not responsible for damage caused by failure to adhere to these instructions.
7. Warranty and Limitations
We warrant that our Services will be performed in a professional and workmanlike manner, using quality materials.
Specific warranty details for tinting film (e.g., against bubbling, peeling, extreme color fading) are provided by the film manufacturer. We will inform you of the applicable manufacturer's warranty.
Our warranty covers defects against bubbling, peeling, extreme fading in materials.
It does not cover
Minor installation defects which are nearly impossible to control due to the nature of film like creases, scratches and small dust particles in the film. Window films are magnetic and static in nature and can pickup dust from air and nearby areas which are impossible to eliminate.
Damage caused by misuse, abuse, accidents, or improper cleaning/maintenance by the Customer.
Damage caused by pre-existing conditions of the Vehicle/Property (e.g., existing window damage, rust, previous tinting imperfectis).
Fingernail scratches, normal wear and tear, or damage caused by impact from foreign s.
Bubbles, hazing, or moisture between the film and glass during the curing process (which is normal and will disappear within 6 weeks, depending on conditions).
Any issues arising from aftermarket accessories or modifications not disclosed to us prior to service.
Any warranty claims must be made in writing within the warranty period, accompanied by proof of purchase.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ATLAS HUE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES, REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Atlas Hue and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms or your use of the Services.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good faith negotiations between the parties.
If a resolution cannot be reached through negotiation, the parties agree to submit to the exclusive jurisdiction of the courts located in Peel Region, Ontario, Canada.
11. Intellectual Property
All content on our Website, including text, graphics, logos, images, and software, is the property of Atlas Hue or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written consent.
12. Privacy
Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, available here. By using our Services, you consent to the practices described in our Privacy Policy.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms, together with any written quotes or invoices provided by us, constitute the entire agreement between you and Atlas Hue concerning the Services and supersede all prior or contemporaneous agreements, understandings, and communications, whether oral or written.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. The "Effective Date" at the bottom of this document will indicate when the Terms were last revised. Your continued use of our Services after any changes indicates your acceptance of the updated Terms.
